TiVo copyright and intellectual property policy
TiVo Inc. respects the copyright and other intellectual property rights of others, and we ask our subscribers to do the same.
The TiVo Service Agreement limits subscriber's use of TiVo products and services to personal, noncommercial use.
It is TiVo's policy to fully comply with the Digital Millennium Copyright Act (the text of which can be found at the U.S. Copyright Office Web Site www.copyright.gov), which provides a procedure for notifying a service provider about intellectual property infringement by third parties. In appropriate circumstances, TiVo's responses may include disabling or terminating the subscription or certain services available to subscribers who repeatedly infringe the copyrights or intellectual property rights of others. The process for notifying TiVo of activity believed to be infringing is set forth in this policy. Only the intellectual property rights owner or its authorized agent can report of potential infringement by a TiVo service subscriber. If you are not the intellectual property rights owner or its authorized agent, you can still help by getting in touch with the rights owner and encouraging them to contact TiVo.
How to provide a Notice of Violation
If you have a good faith belief that infringing activity is occurring through the TiVo service, please provide TiVo's DMCA registered agent written notice with the following information:
- A description of the copyrighted work or other intellectual property that you believe is being infringed;
- A description of the infringing material with sufficient detail that TiVo can readily identify it. If the allegedly infringing material consists of a content file that you believe originated from a TiVo product or service, you must provide (a) the date, time and location where the material was obtained, including any relevant software logs from p2p client, web browser, or similar source and (b) two (2) copies of the allegedly infringing material on individual CD-R or DVD-R (no DVD+R) containing the raw data format as found online, including the original file name as found. The CD-R or DVD-R must use either the ISO 9660 or Windows FAT32 file systems;
- Any contact or identifying information regarding the alleged infringer, if known by you;
- Your name, address, telephone number, and email address;
- Proof of ownership of the copyright of the work, such as a copyright registration. If you are not the owner of the work, identification of the owner of the copyrighted work and, a list of persons authorized to act as agents on behalf of the owner with respect to intellectual property infringement;
- Include the following statement: "I have a good faith belief that the use of the materials is not authorized by the copyright or intellectual property owner, the owner's agent, or the law";
- Include the following statement: "I declare, under penalty of perjury, that the information in this notice is accurate, and that I am the copyright or intellectual property owner or authorized agent of the owner"; and
- An electronic or physical signature.
