The TiVo Payment Plans is the primary document that explains the payment plans governing your subscription to the TiVo service.

1. How Do The TiVo Payment Plans Apply To You?

When you purchase a TiVo DVR and subscribe to the TiVo service, you must agree to the TiVo Service Agreement.  The following TiVo Payment Plans (the "service plan(s)") are subject to and incorporated into the TiVo Service Agreement (the "service agreement"). Except as otherwise set forth in, and subject to, the service agreement, these service plans govern both your subscription to and receipt of the TiVo service and any TiVo DVR you may have received in connection with any service plan. Pricing, terms, and conditions of the TiVo service are subject to change at any time.

BY SELECTING AND ACTIVATING UNDER ONE OF THE FOLLOWING PAYMENT PLANS OR PROMOTIONAL PAYMENT PLANS, YOU REPRESENT THAT YOU ARE OF LEGAL AGE TO ACCEPT TIVO INC.'S OFFER TO SUBSCRIBE TO THE TIVO SERVICE AND THAT YOU HAVE READ AND UNDERSTAND FULLY THE TERMS AND CONDITIONS OF THE PAYMENT PLANS AND THE TIVO SERVICE AGREEMENT.

Without a subscription to the TiVo service, your TiVo DVR will not work! Please see Section 7 of the TiVo Service Agreement.

2. Which TiVo Payment Plans Are Available?

A. At the time of activation of a service plan, you can pay for a subscription to the TiVo service on a monthly or prepaid basis.  Promotional Pricing may also be available from time-to-time.  TiVo reserves the right to terminate the offer of Promotional Pricing at any time without notice.

B. You may purchase a subscription to the TiVo Service in one of the following ways:

(i) For TiVo Premiere boxes:

(a) When purchasing a TiVo Premiere box and subscription at the same time directly from TiVo, you may select one of the following options:

(1) You may purchase a TiVo box and service bundle with (a) a box fee of $99.99 (includes an instant $200 savings off MSRP) for the TiVo Premiere box or $299.99 (includes an instant $200 savings off MSRP) for the TiVo Premiere XL box and (b) a monthly service fee of $19.99 a month with a one (1) year commitment (renews monthly after one year) or you may purchase a Product Lifetime Subscription (defined below) for a onetime fee of $499.99; or

(2)  You may purchase a TiVo box and service bundle at (a) the full MSRP (no instant savings) box fee of $299.99 for a TiVo Premiere box or $499.99 for a TiVo Premiere XL box and (b) subscribe to the TiVo Service on a monthly basis for $19.99 a month with no commitment (renews monthly until you cancel) when you order by phone.

(b) When purchasing a TiVo Premiere box from a third party retailer at $99.99 (includes an instant $200 savings off MSRP) for the TiVo Premiere box or $299.99 (includes an instant $200 savings off MSRP) for the TiVo Premiere XL box, you may only subscribe to the TiVo Service on a monthly basis for $19.99 a month with a one (1) year commitment (renews monthly after one year) or you may purchase a Product Lifetime Subscription (defined below) for a onetime fee of $499.99.

(ii) When purchasing a TiVo Premiere Elite box from TiVo directly or from a third party retailer at $499.99, you may only subscribe to the TiVo service on a monthly basis for $19.99 a month with no commitment or you may purchase a Product Lifetime Subscription (defined below) for a onetime fee of $499.99.

(iii) For all other TiVo boxes, you may subscribe to the TiVo Service on a monthly basis for $12.95 a month with no commitment or you may purchase a Product Lifetime Subscription (defined below) for a onetime fee of $499.99.

3. Do Early Termination Fees Apply To Any TiVo Payment Plans?

A. An early termination fee applies to only monthly service plans that included a 1 year commitment as follows:

(i) If you subscribe to the TiVo service on a $19.99 a month plan with a one (1) year commitment, you can cancel your subscription to the TiVo service at any time, but if you do so before the end of your initial one (1) year commitment, you will be assessed an amount equal to $200 minus $15 per month for each month of your subscription that you fulfilled, except as permitted by the 30-Day Money Back Guarantee.

B. No early termination fee applies to no commitment and prepaid service plans (Product Lifetime Subscriptions), but no refunds will be paid for cancellations of any no commitment or prepaid service plan except as permitted under TiVo's 30-Day Money Back Guarantee.

4. Does The 30-Day Money Back Guarantee Apply To TiVo Payment Plans?

5. If My TiVo Payment Plan Includes A Commitment, What Happens At The End Of That Commitment?

If you purchased a monthly service plan including a one (1) year commitment, TiVo will continue to charge you after the end of your commitment on a monthly basis at the same monthly service plan rate, subject to the terms of the TiVo Service Agreement.

6. How Long Does The Product Lifetime Service Subscription Last?

The Product Lifetime Subscription to the TiVo service includes a subscription for the useable life of the TiVo DVR you buy – not the life of the subscriber – and may not be transferred to another TiVo DVR.  A Product Lifetime Subscription accompanies the TiVo DVR it is associated with in case of ownership transfer of that TiVo DVR.  For more information on Product Lifetime Subscriptions, please refer to the TiVo Service Agreement. Of course, hardware products don't last forever and their lifespan will vary.  TiVo makes no warranties or representations as to the expected lifetime of the TiVo DVR (aside from the manufacturer's Limited Warranty).

7. Does The TiVo Payment Plan I Purchase Come With A Warranty?

For all service plans, TiVo makes no warranties or representations aside from the manufacturer's Limited Warranty.  TiVo may also offer from time to time two (2) year and three (3) year extended warranty plans for purchase ninety (90) days from the earlier of the DVR purchase date or TiVo service activation date.

8. Are There Any Discounts That Apply To The TiVo Payment Plans?

A. The $12.95 monthly, $19.99 monthly with a 1 year commitment, and Product Lifetime Subscription service plans are eligible for the Multi-Service Discount at the time of initial activation. See full terms of the Multi-Service Discount for details.

B. Purchases of TiVo DVR and TiVo service plans from http://www.tivo.com cannot be combined with any other offers or discounts, including any TiVo mail-in rebates. TiVo Service Gift Subscriptions, including TiVo Service Gift Cards purchased at Best Buy, cannot be used in conjunction with any purchase of a TiVo DVR.

9. What If I Fail To Pay For My TiVo Payment Plan?

If you fail to pay any amounts owing to us in connection with these TiVo Payment Plans terms, TiVo reserves the right to pursue such unpaid amounts and you will remain liable to us for all charges under these TiVo Payment Plan terms and all the costs we incur to collect these charges, including, without limitation, collection agency fees, reasonable attorneys' fees, and arbitration or court costs.
